Sales call recording laws by state, with a consent script you can copy
Pick your state and your prospect's state to see whether everyone on the call needs to agree before you record.
Choose both states to see the result.
Rules can change and other rules may apply, such as calls outside the US or recording on third-party platforms. This is general information, not legal advice.
Quick heads-up before we start: I record my calls and use AI-assisted notes so I can follow up accurately. Is that okay with you?
If they say no: 'No problem, I'll take notes by hand instead.'

How to apply these rules
Which rule applies when the two people are in different states
When you and your prospect are in different states, follow the stricter rule. If either state requires everyone's consent, get consent from everyone on the call.
What counts as consent
Say it clearly at the start of the call and get a spoken yes. Or put it in the calendar invite and confirm again when the call starts.
AI notes and transcripts
Disclose AI-assisted transcription and note-taking the same way you disclose recording. Treat it as a recording for consent purposes.
What to do if someone says no
Stop recording, turn off AI transcription, and take notes by hand instead.
Frequently asked questions
Do I need consent to record a sales call?
It depends on the states involved. In one-party states you can record as a participant, but in all-party states everyone on the call must agree. When in doubt, ask everyone at the start of the call.
What is the difference between one-party and all-party consent?
One-party consent means only one participant, which can be you, needs to agree to the recording. All-party consent means every person on the call must agree before you record.
Which states require everyone's consent?
California, Connecticut, Delaware, Florida, Illinois, Maryland, Massachusetts, Montana, Nevada, New Hampshire, Pennsylvania and Washington. Michigan, Oregon and Vermont are unclear or mixed, so treat them as consent required. A few of these states have caveats, so check the table above.
Do I need consent to use AI to transcribe my calls?
Treat AI transcription the same as recording. Disclose it at the start of the call or in the invite, and get the same consent you would for a recording.
What should I say at the start of a recorded call?
Something short and clear, such as: "Quick heads-up before we start: I record my calls and use AI-assisted notes so I can follow up accurately. Is that okay with you?" Then wait for a spoken yes.
